TOWN  HALL  MEETINGS  FOR  ROYALTY  OWNERS  NEXT  WEEK

We invite royalty owners who have leased mineral rights in Bradford County (or in adjacent townships in Sullivan, Susquehanna and Wyoming Counties) to attend one of our upcoming Town Hall Meetings, to meet our litigation team, to earn more about our planned approach, and to get answers to any questions you may have. The meetings scheduled for next week will be held:

Tuesday, December 16, 2014, at 9:00 a.m. at the Ulster-Sheshequin Fire Hall, 85 Rescue Street, Ulster; 

Tuesday, December 16, 2014, at 1:00 p.m. at the New Albany Fire Hall, Main Street, New Albany;  

Tuesday, December 16, 2014, at 6:00 p.m. at the Wyalusing Presbyterian Church, 120 Church Street,Wyalusing; and

Wednesday, December 17, 2014, at 1:00 p.m., at the LeRoy Community Association Building, Mill Street, LeRoy.

There is no cost to attend, no obligation involved, and no need to register in advance.

The DOJ and state investigations of Chesapeake which were disclosed in Chesapeake's Form 10-Q filed with the SEC on November 6, finally have been picked up by the Associated Press, and are getting renewed press coverage a month later. Followers of Facebook page and this website learned about the disclosure here, and on our Facebook page, on Nov. 7. 

Among other things, Chesapeake disclosed in its Form 10-Q that it has "accrued a loss contingency" of $100 million on its financial statements in connection with a royalty owner class action filed on behalf of Oklahoma royalty owners in 2010.

The ongoing investigations by the DOJ and Pennsylvania attorney general DO NOT mean that royalty owners can afford to sit back and wait for the government to take action. Although any judgment or settlement in favor of the DOJ or PA AG would probably be helpful to us, a judgment, fine or settlement in favor of the government would not necessarily put any $ in your pocket for prior underpayments, which is what we will be seeking to do as part of the Marcellus Royalty Action. For that, you will need to pursue your own claims.

Although the Marcellus Royalty Action is focused on Bradford County, we recognize that some of the same issues we see in Bradford County appear to be affecting Chesapeake royalty owners in several townships in Sullivan, Susquehanna and Wyoming counties adjacent to Bradford County.  As a result, Chesapeake royalty owners those townships are also welcome to attend our upcoming town hall meetings on December 16 in Wyalusing, New Albany or Ulster,  or on December 17 in LeRoy. We would be pleased to evaluate your royalty statements and potential claims to see if they fall within the scope of our intended action.

CHESAPEAKE  SUBPOENED  BY  DOJ  AND  STATES  OVER POSSIBLE  ANTITRUST  VIOLATION  AND  ROYALTY  PAYMENT   PRACTICES

Two interesting pieces of information from the Form 10-Q quarterly report that Chesapeake filed with the SEC on Wednesday, November 6 for the quarter ended September 30.

First, Chesapeake said its third-quarter profit more than tripled, as the company posted sharply higher revenue in its natural gas and oil segment and increased production. 

Second, Chesapeake confirmed that it has received, from the U.S. Department of Justice (DOJ) and certain state governmental agencies and authorities, subpoenas and demands for documents, information and testimony in connection with investigations into possible violations of federal and state antitrust laws relating to its purchase and lease of oil and gas rights in various states, as well as subpoenas seeking information on the Company’s royalty payment practice.

These investigations are consistent with the approach we are taking to litigating the direct damage claims of individual royalty owners in group actions. 

At this point, the DOJ and state investigations (including by the Pennsylvania Attorney General's Office) are ongoing, and no one knows what the outcome(s), if any, will be. Regardless of what happens (or does not happen) as a result of the investigation, we believe that the best way for individual royalty owners to maximize and protect their individual damage claims is by direct group actions.
